Terms of Service

These Terms of Service ("Terms") are an agreement between you and ClaritySends ("we", "us"). They cover claritysends.com and claritysend.hiredock.io, ClaritySends Recruiters, ClaritySends Leads and ClaritySends Candidates, our API and MCP access, and anything sent through them (together, the "Services").

By creating an account or using the Services you accept these Terms and our Privacy Policy. If you use the Services for a company, you accept them for that company and confirm you may do so.

• You must be at least 18.
• Give accurate information and keep it up to date.
• Keep your sign-in secure. You are responsible for what happens in your account and your workspaces.
• Workspace owners decide who joins their workspace and what they can do, and are responsible for their members.

ClaritySends helps you find the right people, write each of them a personal email, and handle the replies in one inbox. Each product is built for one kind of outreach:

• Recruiters: attach jobs, let a scout find candidates who fit, email them about the role, and publish public job pages.
• Leads: describe your offer and buyer, let a scout find decision makers, email them and, if you turn it on, have an AI voice assistant call them.
• Candidates: build and tailor resumes, share them by public link, and email the recruiters and hiring managers behind the roles you want.

Features use AI and third-party data. Contact details, fit scores, email drafts, resume suggestions and call summaries can be wrong or out of date. Review what matters before you rely on it or send it.

We do not guarantee replies, hires, sales, interviews or job offers. We are not a recruiter, employer, staffing agency or sales agent, and we are not a party to anything you agree with the people you contact.

You decide whom to contact and what to send, and you are the sender of every email and the caller of every call made from your workspace. You must follow the laws that apply to it, including anti-spam laws (such as CAN-SPAM, CASL, the GDPR and the ePrivacy rules), telemarketing and calling laws (such as the TCPA and do-not-call rules), data protection laws, and employment and anti-discrimination laws.

In particular, you agree to:

• Contact people only for a genuine professional reason relevant to them.
• Identify yourself honestly, use a real sender name and a working reply address, and never forge headers or impersonate anyone.
• Keep the unsubscribe link in campaign emails, and honor every unsubscribe and do-not-contact request promptly.
• Have the right to use any contact list you import, including any consent the law requires.
• Stay within the sending limits we set and the limits of your email provider.
• Not discriminate against candidates on any protected ground.

AI phone calls (Leads)

• You may call only business numbers, for business purposes, where the law allows calls made with an artificial or AI voice without prior consent, or where you have that consent.
• You must not remove or change the AI and recording disclosure the assistant gives at the start of every call.
• You are responsible for calling hours, do-not-call registries and recording-consent rules that apply to the people you call. The Services limit calls to local daytime hours and keep a do-not-call list per workspace, but this does not replace your own compliance.

You must not use the Services to:

• Send bulk unsolicited messages, spam, phishing, malware or misleading content.
• Harass, threaten or deceive anyone, or contact people who have asked you to stop.
• Sell, publish or hand over contact data you get from the Services, or use it to build a competing database.
• Contact consumers at personal addresses or numbers for marketing where the law forbids it.
• Scrape, overload, reverse engineer or get around the limits or security of the Services.
• Upload content you have no right to use, or anything illegal.
• Use another person’s account, or resell the Services without our written permission.

We may review usage, pause sending or calling, or limit features to protect deliverability, recipients and other users, and we may report illegal activity.

When you connect Gmail, another email provider, or your own AI, telephony, voice, verification or storage account, you authorize us to use that account to provide the features you turn on: sending emails you approve or schedule, reading replies to them, placing calls you schedule, and storing files. You can disconnect at any time.

Those services have their own terms and charges, which you are responsible for. We are not responsible for their outages, limits or decisions, such as a provider suspending a sending account.

You keep ownership of what you add: templates, jobs, offers, personas, resumes, files and contact lists ("Your Content"). You give us permission to host, process and send Your Content only as needed to provide and secure the Services, including passing it to our AI and delivery providers.

You are responsible for Your Content and confirm you have the rights to it. What the AI writes for you is yours to use, but you should check it first.

A resume or job you make public can be seen by anyone with the link or page until you turn it off. Copies others made in the meantime are outside our control.

• Some features need a paid plan or credits. Prices and limits are shown before you buy.
• Payments are processed by Stripe. Subscriptions renew automatically at the end of each period until you cancel.
• You can cancel at any time in your billing settings. Cancellation takes effect at the end of the current period, and you keep access until then.
• Fees are not refundable except where the law requires or we agree in writing.
• Usage of third-party services you connect (for example AI, telephony or sending) is billed by those providers, not by us.
• We may change prices with at least 30 days’ notice; the change applies from your next renewal.

The Services, including the software, design, AI prompts, templates we provide and the ClaritySends name and logos, belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Services under these Terms. If you send us feedback, we may use it without any obligation to you.

You can stop using the Services and close your account at any time. We may suspend or close an account, a workspace, or sending and calling, if you break these Terms, if your outreach causes complaints, bounces or legal risk, if payment fails, or if the law requires it. Where reasonable we will tell you first.

After closing, you can ask us to export Your Content for 30 days. Sections that by their nature should continue (for example payment owed, ownership, disclaimers, liability and indemnity) survive.

The Services are provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and the accuracy of contact data or AI output. We do not promise the Services will be uninterrupted or error free, or that emails will be delivered.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or opportunities. Our total liability for any claim about the Services is limited to the greater of the amount you paid us in the 12 months before the claim and US $100.

You will defend and indemnify us against claims, fines and costs that arise from Your Content, your outreach (the emails you send and calls you place), or your breach of these Terms or the law.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Courts in Wyoming have exclusive jurisdiction, except that either side may seek urgent relief in any competent court. If you are a consumer, you keep the protections of the law where you live.

We may update these Terms. We post the new version here with a new date, and for material changes we tell you by email or in the app at least 14 days before they take effect. Using the Services after that means you accept the new Terms.

These Terms and the Privacy Policy are the whole agreement between us about the Services. If a part is unenforceable, the rest still applies. Not enforcing a right is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them with our business.
